There are three reasons that Government Islamia College Complex Building Karachi should be acquire by Government of Sindh.
A) That Islamic Education Trust is the owner of Government Islamia College Complex Building Karachi.
That the Official Assignee Karachi is directed by Honourable High Court of Sindh Karachi in Constitutional Petition Number D-96 of 2001 order dated 07-09-2001 “ …to assume the power of the owner of the property and take such measures as he considers necessary or expedient to protect the owners’ interest in accordance with the Trust Deed”. That according to the Islamic Education trust deed of 1958 there is no clause in the Islamic Education Trust deed for eviction of educational institutions in Islamic Education Trust’s property. That according to the Islamic Education trust deed of 1958 there is no clause in the Islamic Education Trust deed for collection of rent from educational institutions in Islamic Education Trust’s property. That the Official Assignee Karachi is not protecting the owner’s interest in accordance with the Islamic Education Trust deed of 1958. That the Official Assignee Karachi is never ever directed/authorized by the Honourable High Court of Sindh Karachi to seek eject of the educational institutions in Islamic Education Trust’s property.
B) That the first rent agreement signed between Quaid-i-Taleem Late Mr. A. M. Qureshi, one of the founder trustee of the Islamic Education Trust as party one and Late Mr. G. M. Khan, the Principal of Islamia College (as member of Islamic Education Society) as party two in August 1961. That Islamic Education Trust became landlord and Islamic Education Society became leaseholder of the land. This first rent agreement is a foundation in rent case 413 of 2004 (The Official Assignee of Karachi V/s CDGK and Others). However Mr. Qureshi could not sign the agreement unless all the trustees give him powers to do so. In other wards one trustee cannot sign a rent agreement unless all the trustees pass a resolution to give him/her the power to do so. Mrs. Mumtaz Qureshi Muzakkir Hussain one of the founder trustee confirmed us that no such resolution was passed, rendering the agreement void. That is a reason till today no one including current Official Assignee of Karachi did not submitted this resolution in any court! How can the current Official Assignee of Karachi take possession of the building on the basis of a void agreement?
C) That Islamic Education Trust has refuse to comply the clause number four of the agreement’s further on the following term and condition with Karachi Municipal Corporation now a day known as City District Government in Karachi vide their resolution number 1255 dated 27th May, 1958 by building ground and three floors but according to agreement only ground and first floor are allowed. On above ground City District Government in Karachi may cancelled ninety-nine years lease of plot number 490, M.A. Jinnah Road, Jamshed Quarter, Karachi, Pakistan for the sake to save future of thousands of students in Government Islamia College Complex Building Karachi.

Mrs. Mumtaz Qureshi Muzakkir Hussain (Founder Trustee of Islamic Education Trust and eldest daughter of Quaid-e-Taleem Late Mr. A. M. Qureshi [Founder of Islamia College Complex Building Karachi.] and wife of Syed Muzakkir Hussain) and her group submitted a petition dated 8th November, 2008 to the Honourable President of Pakistan on the behalf of Islamic Education Trust is the real owner of Government Islamia College Complex Building Karachi. That they have no objection if the Sindh Government acquire the Government Islamia College Complex Building situated at plot number 490, M.A. Jinnah Road, Jamshed Quarter, Karachi, Pakistan for the sake of education and security of more than twenty thousand students. Now time has come for City District Government Karachi to cancel ninety-nine years lease agreement of Islamic Education Trust and time has come for Government of Sindh to acquire the Government Islamia College Complex Building Karachi as soon as possible for the sake of education and security of more than twenty thousand students.
Time Has Come To Secure Thousands of Students Education From Eviction of Educational Institutions In Government Islamia College Complex Karachi.
Islamia College Complex Building Karachi is founded by Quaid-i-Taleem Late Mr. A. M. Qureshi. He married twice and had twelve children. From his first wife Mrs. Kulsoom Bi Qureshi’s four children namely Mr. Muhammed Hussain Qureshi, Mrs. Mumtaz Qureshi Muzakkir Hussain, Mrs. Afroze Shah and Mr. Khalid Rehman Qureshi. From his second wife Mrs. Hafizunnisa Bi Qureshi’s eight children namely Mr. Sabir Qureshi, Mrs. Shahida Aftab w/o Mr. Aftab Ahmed Khan, Mr. Tariq Qureshi, Mr. Nasir Qureshi, Mr. Iqbal Qureshi, Mrs. Seema Qureshi w/o Mr. Ghulam Rasool Unnar, Mr. Akber Qureshi and Mr. Altaf Qureshi.
Islamic Education Trust (Regd.) in 1958 is the owner of Government Islamia College Complex Karachi.
That Quaid-i-Taleem Late Mr. Abdul Rehman Muhammad Qureshi, also known as Late Mr. A.M. Qureshi with active assistance and support of his eldest son Muhammed Hussain Qureshi, Late Mr. Arif Bhai s/o Late Mr. Muhammad Olla, Late Mr. Abdul Hameed Sufi s/o Late Mr. Abdul Majeed Sufi, and his eldest daughter Mrs. Mumtaz Qureshi w/o Syed Muzakkir Hussain (who was a minor and was represented through her father Late Mr. A.M. Qureshi), constituted, founded and established a charitable educational Trust which is known as the Islamic Education Trust. That the Original Trust Deed of the Islamic Education Trust is duly registered on or about first week of March1958.
That one of the founding trustees, namely Late Mr. Abdul Hameed Sufi s/o Abdul Majeed Sufi, resigned as Trustee from the Islamic Education Trust on 24th June1969 and same was accepted. In para 3 of Late Mr. Abdul Hameed Sufi’s counter affidavit presented in the High Court of Sindh Karachi on 05th August1971, in Civil Suit No. 153 of 1971, Ms. Anita Ghulam Ali & Others…Plaintiffs Versus Mr. A. M. Qureshi & Others…Defendants.
Late Mr. Abdul Hameed Sufi stated as follows:
“That I have resigned from the office of the Trustees as early as on 24th June 1969 and the same was accepted. I have thereafter nothing to do with the affair of the Trust and I have been made a party unnecessarily”.
That on 1st September, 1972 all of the properties and assets of the Islamic Education Trust were taken over by the Government of Pakistan under MLR 118 and all of the educational institutions in the Islamia College Complex Karachi were nationalized.
That after the death of the above mentioned three founding trustees, the surviving member trustees Mr. Muhammed Hussain Qureshi and Mrs. Mumtaz Qureshi Muzakkir Hussain herein by Deed of Appointment of New Trustees, in compliance of the Rules of the Trust, appointed in good faith Mrs. Afroze Shah w/o Syed Anwer Ali Shah, Mr. Khalid Rehman Qureshi s/o Late Mr. A. M. Qureshi and Mr. Ismail Asghar Qureshi born U.S.A. Citizen (who at the time of his appointment was a minor) s/o Mr. Khalid Rehman Qureshi as all three of them new Trustees.
That the Mrs. Afroze Shah without permission, consent and knowledge started filing proceedings in the Honorable High Court of Sindh Karachi with fake signatures of Mr. Muhammed Hussain Qureshi filed False Extract Board of Resolution of Islamic Education Trust dated 19th December 2000 filed in C.P. D-96/2001{Islamic Education Trust Versus Province of Sindh & Others}, In The High Court of Sindh, Karachi and she designated herself as General Secretary. That at no point of time was the Mrs. Afroze Shah selected / elected and or appointed as General Secretary of the Islamic Education Trust.
That it is further stated that Mrs. Mumtaz Qureshi Muzakkir Hussain since 2007 joined the proceedings as intervenor in C.P. No. D-96 of 2001{Islamic Education Trust Versus Province of Sindh & Others}, In The High Court of Sindh, Karachi.
That the Mrs. Afroze Shah started to indulge in unlawful and questionable activities such as using fake signatures of Board members and assenting herself from Board meeting consecutively. She was, therefore, removed from Board of Trustees vide Resolutions of the Board dated 205th August, 2004.
That Mr. Khalid Rehman Qureshi and Mr. Ismail Asghar Qureshi have also avoided to attend the Islamic Education Trust’s meeting and the affairs, aim and objects of the Trust have been neglected by them Mr. Khalid Rehman Qureshi may be comes once in an year from U.S.A., whereas Mr. Ismail Asghar Qureshi is born U.S.A., Citizen from the date of his appointment as Trustee neither came in Pakistan nor attended any meeting of the Trust and had at all not taken interest in the affairs of the Trust. Mr. Khalid Rehman Qureshi and Mr. Ismail Asghar Qureshi in the meeting of the Trust dated 25th August, 2004 have been removed for their non participation in the meetings and the affairs of the Trust as well.
That by another resolutions dated 25th August 2004 passed, Mr. Syed Kamran Hussain s/o Syed Muzakkir Hussain & Mrs. Mumtaz Qureshi Muzakkir Hussain others namely Mr. Mazhar Ali Nanjiani s/o Mr. Mehmood Ali Nanjiani, Mr. Khwaja Adnan Ali s/o Late Mr. Khawaja Ahsan Ali, Mr. Inayat Ibadullah Khan s/o Late Mr. Haji Ibadullah Khan and Mrs. Sarwat Qureshi w/o Mr. Goher Mubashir Hameed & d/o Mr. Muhammed Hussain Qureshi are appointed as member of Board of new Trustees. After that the Deed of Appointment was duly registered at Regd. No. 458 of the Book IV dated 18th November, 2004 and M. F. Roll No. U-78541/2160 dated 26th November, 2004 of Photo Registrar Karachi.
That Mrs. Afroze Shah, her son Syed Mureed Ali Shah, her daughter Ms. Asiya Shah, Mr. Khalid Rehman Qureshi and his son Mr. Ismail Qureshi posing themselves as Trustees filed a Civil Suit No. 107 of 2008 (Islamic Education Trust and others v/s Syed Kamran Hussain & others) against the present trustees in the High Court of Sindh Karachi. Mr. Syed Mureed Ali Shah and Asiya Shah have not even for a single day from the inception of the Trust till now, been bonafide Trustees of the Islamic Education Trust.
That Mr. Sabir Qureshi, Mrs. Shahida Aftab w/o Mr. Aftab Ahmed Khan, Mr. Tariq Qureshi, Mr. Nasir Qureshi, Mr. Iqbal Qureshi, Mrs. Seema Qureshi w/o Mr. Ghulam Rasool Unnar, Mr. Akber Qureshi and Mr. Altaf Qureshi are also posing themselves as Trustees filed a Civil Suit 04 of 2008 (Islamic Education Trust and others v/s Muhammad Husain & others) in the High Court of Sindh Karachi against Muhammed Hussain Qureshi, Mrs. Mumtaz Qureshi Muzakkir Hussain, Mrs. Afroze Shah, Mr. Khalid Rehman Qureshi and Mr. Ismail Asghar Qureshi. It is surprising that Mr. Akber Qureshi and his group of so-called trustees filed new suit after around thirty months later of their High Court Appeal 37 of 2002 in the High Court of Sindh Karachi is dismissed and instead of filing an appeal in the year of 2005 in The Supreme Court of Pakistan but they file new Civil Suit in the High Court of Sindh Karachi. Mr. Akber Qureshi and his group of trustees have not even for a single day from the inception of the Trust till now been bonafide Trustees of the Islamic Education Trust.
The Light Side Mr. Syed Kamran Hussin, Trustee/General Secretary of Islamic Education Trust and his Group of Trustees are totally supporting over twenty thousand students by offering Government of Sindh to acquire Government Islamia College Complex Karachi and if rent is due than Government of Sindh should use this fund for Student’s scholarship by creating society but The Dark Side Mrs. Afroze Shah So-Called Trustee/So-Called General Secretary of Islamic Education Trust and her Evil Group of Trustees are totally against over twenty thousand students and badly want to grab Government Islamia College Complex Karachi with the illegal help of Official Assignee Karachi including if rent is due. In Between The Side Mr. Akber Qureshi So-Called Trustee/So-Called General Secretary and his So-Called Group of Trustees are waiting and watching for Government Islamia College Complex Karachi and if any rent is due to hunt like a crocodile!!!!!
More Than Twenty Thousand Students Of Islamia College Complex Karachi And Their Familes Are With Mr. Syed Kamran Hussain And His Group Why?
Mr. Syed Kamran Hussin pro education & pro students of Islamia College Complex Karachi, Trustee/General Secretary of Islamic Education Trust {Islamic Education Trust is the owner of Government Islamia College Complex Karachi} and his group are totally supporting over twenty thousand students in Government Islamia College Complex Karachi but Mrs. Afroze Shah so-called Trustee/so-called General Secretary of Islamic Education Trust and her evil group are totally against over twenty thousand students and badly want to grab Government Islamia College Complex Karachi with the illegal help of Official Assignee Karachi.
Order dated on 5th May 2009 in civil suit Number 01 of 2008 {Islamic Education Trust and Others…Plaintiffs Versus Mrs. Afroze Shah and others…Defendants} by Mrs. Romana Siddiqui 2nd Addittional District Judge Karachi West:
“…….Since order granting permission to withdraw a suit is not a decree neither it deals judiciously with subject matter of suit. Hence I am of the true view that if the plaintiffs is of the view that his suit can fail due to some technical or informal reasons (Illegally 92 CPC permission turn down to file suit by Advocate General Sindh!!!!!) and want to withdraw the suit to correct the discrepancies, he is at liberty too. Hence in view of above, I allow the application Under Order 23 Rule 1 & 2 CPC for withdrawal of the suit, with permission to file fresh suit.”
After order dated 5th May, 2009 which is announced in open court. Mr. Syed Kamran Hussain and his angel group of trustees will act as trustees and will make correspondence in above subject regards with any of the office except Official Assignee Karachi and their the deeds of appointment of trustees dated 18th November 2004 & the deed of amendment dated 23rd November, 2004 is not any more under suspension because of final disposal of the civil suit number 01 of 2008 by the 2nd Additional and District Judge Karachi West.
According to law dead line to file fresh suit is not mention in order dated 5th May, 2009. Now Mrs. Afroze Shah and her evil group of trustees stand no where because they agree with order dated 28th January, 2009 in civil suit number 107 of 2008 {Islamic Education Trust & Others…Plaintiffs Versus Syed Kamran Hussain & Others…Defendants} by Mr. Zafar Ahmed Khan Sherwani in the High Court of Sindh Karachi which is disposed and decree is also issued by The High Court of Sindh Karachi.
“Learned Counsel for the parties have filed their respective document which are taken on record, however, they agree that this suit may be disposed of in the following terms:
1) That the defendants No.1 to 7 will not act as trustees and will not make correspondence in this regards with any of the office till the final disposal of suit No. 01 of 2008 pending before the 2nd Additional and District Judge, West Karachi.
2) The the deeds of appointment of trustees dated 18th November, 2009 and deed of amendment dated 23rd November, 2009 as mentioned in prayer clause B of this suit will remain under suspension till final disposal of the suit No. 01 of 2008.
3) The Official Assignee Karachi will be restrained from taking any instruction from any of the parties mentioned in the present suit No. 107 of 2008. However, he will be bound to act as orders of this court in CP No. D-96 of 2001.
In view of the above, the suit is disposed of in terms of the above along with listed applications.”
The main reason for suit No. 01 of 2008 finally disposed by just a conditional withdraw application because in the final order of suit No. 107 of 2008 the most important point i.e. issue frame of trustees is not mention.
Just for information now if any one will take any instruction regarding Islamic Education Trust by Mrs. Afroze Shah and her evil group of trustees & also try to do correspondence or reply their correspondence than that one will pay price by law.

For your kind information on 8th November 2008, the General Secretary of Islamic Education Trust [Is the owner of Government Islamia College Karachi], Mr. Syed Kamran Hussain had sent a petition to the President of Pakistan, Mr. Asif Ali Zardari. In this petition Mr. Syed Kamran Hussain has suggested that they have no objection if the government were to acquire the land in order to protect and secure the education of thousands of students which are studying in the said the complex.
The President’s office has forwarded this petition to the Chief Secretary Sindh. This petition has been further forwarded to the Sindh Education Secretary who them forwarded the petition to Mr. Manzoor Hussain Vistro, Section Officer (JUD) for Secretary to Government of Sindh, Education and Literacy Department.
On 17th February 2009, Mr. Vistro had written a letter to The Law Secretary to Government of Sindh, Law Department, Karachi, requesting legal advise as to how the government can come to acquire the Government Islamia College Complex Karachi. Mr. Vistro has sent a second reminder to the same party on 31st March 2009 & third reminder to the same party 23rd April, 2009.
Till date no legal advise has been offered by the Law Secretary to Government of Sindh, Law Department, Karachi as to how the government of Sindh can legally acquire the said premises.
The concerned authorities like you should pressurize the Law Secretary to Government of Sindh, Law Department, Karachi to send their advise as soon as possible.
Further please note the following points:
1. KMC (City District Government Karachi) had allotted the land to the Islamic Education Trust on 27.5.1958 under Resolution No. 1255.
2. In clause No. 4 of this agreement, the Islamic Education Trust was permitted to build ground plus one floor. However, the Islamic Education Trust has violated these terms and conditions, specifically clause No. 4, by constructing ground plus three floors.
3. This property, upon which Islamia College Complex Karachi was built, was granted by the government as a “Pepper Grant” a term used then at Rs. 2/- per annum for education purposes, which is proof that this land is an immunity plot.
4. The City District Government Karachi can legally cancel the 99 years lease of the plot upon which Islamia College Complex Karachi has been built solely because The Islamic Education Trust has violated cause No. 4 of the said agreement.
In order to secure the education and future of 20,000 students, the City District Government Karachi would have to pass a resolution.
We all citizens of Islamic Republic of Pakistan do not want to allow any one to repeat the history of Lal Masjid (Red Mosque) Islamabad in Islamia College Complex Building Karachi. Because Students in Islamia College Complex Building Karachi are equally important as our brothers, our sisters & our children!
We hope that you shall take personal interest for the sake to secure more than twenty thousand student’s education and safety in the above matter and kindly do the needful.

[I] This is regarding High Court Appeal No. 274 of 2008, in the High Court of Sindh, Karachi. This High Court Appeal concerns the rent or execution of Government Islamia College Complex, Karachi.

2. Please question the concerned authorities, i.e. Mr. Manzoor Ahmed, EDO Education, City District Government Karachi, why this grave negligence has occurred? Were they not aware what impact this would have on the 20,000 students that are currently attending Islamia College Complex Karachi? Do they not know that this is not just 20,000 students, the City District Government is playing with the futures of 20,000 families or should I say the future of Karachi?

[III] This following information below is regarding Civil case of Execution
No. 17 of 2008 for Rent Case No. 413 of 2004, in the court of 3rd Rent Controller, East, Karachi. This case also deals with the collection of rent or evacuation of Government Islamia College Complex, Karachi.

· Islamic Education Trust, Applicant – represented by Mr. Kadir Buksh Umrani seventy five years old, Official Assignee Karachi

· City District Government Karachi and Others, Opponent
Please note carefully the following points:
1. The Province of Sindh and the General Secretary of Islamic Education Trust, Syed Kamran Hussain, have both filed an application u/s 12 (2) r/w section 20 of Sindh Rented Premises Ordinance 1979 on 7th November 2008.
2. In this application, General Secretary of Islamic Education Trust, Syed Kamran Hussain, has requested the concerned court to dismiss the orders of vacating the Islamia College Complex Karachi.
3. Mr. Hussain’s Counsel claims that the rent or evacuation order that has been issued is strictly against the Islamic Education Trust Deed Reg’d 1958. In the Trust Deed there is no mention of either asking for rent or vacating the building.
4. The Islamic Education Trust is a charitable trust which was built with the sole purpose of educating the masses of students who were unable to get admission at other colleges in Karachi. The order for rent or evacuation of said premises must be recalled.
5. The final argument in the above mentioned case has been held on 24th January 2009. Since that day the case has been held with no final judgment so far. The 3rd Rent Controller East Karachi issued the following dates for this case: first, 10th February 2009; second date of 28th February 2009; third date of 21st March 2009; fourth date of 04th April 2009; fifth date of 30th April 2009. On each of these 5 days, the 3rd Rent Controller East Karachi would simply announce a new date for proclaiming judgment on this case. Now the case has been scheduled for proclamation of judgment on the 20th May 2009. Since the final arguments have already been urged we request the concerned authorities to ask the 3rd Rent Controller East Karachi to kindly announce his judgment in this matter.
6. The City District Government Karachi is already a party in the above mentioned case. However, no counsel has represented the CDGK in this case at all. We request the concerned authorities to kindly question Mr. Manzoor Ahmed, EDO Law, CDGK, why this grave negligence has occurred? Why is the City District Government of Karachi not being represented by a counsel in this case? Do they not know that this is not just 20,000 students, the City District Government is playing with the futures of 20,000 families or should I say the future of Karachi?
[IV] On 8th November 2008, the General Secretary of Islamic Education Trust, Mr. Syed Kamran Hussain had sent a petition to Your Excellency the President of Pakistan. In this petition Mr. Hussain has suggested that they have no objection if the government were to acquire the land in order to protect and secure the education of thousands of students which are studying in the said the complex.
The President’s office has forwarded this petition to the Chief Secretary Sindh. This petition has been further forwarded to the Sindh Education Secretary who them forwarded the petition to Mr. Manzoor Hussain Vistro, Section Officer (JUD) for Secretary to Government of Sindh, Education and Literacy Department.
On 16th February 2009, Mr. Vistro had written a letter to The Secretary to Govt of Sindh, Law Department, Karachi, requesting legal advise as to how the government can come to acquire the Government Islamia College Complex Karachi. Mr. Vistro has sent a second reminder to the same party on 31st March 2009 & third reminder to the same party 23rd April, 2009.
Till date no legal advise has been offered by the Secretary to Govt. of Sindh, Law Department, Karachi as to how the government can legally acquire the said premises.

This following information below is regarding civil case of Execution No. 17 of 2008 for Rent Case No. 413 of 2004, in the court of 3rd Rent Controller, East, Karachi. This case also deals with the collection of rent or evacuation of Government Islamia College Complex, Karachi.
The parties concerned are:
· Islamic Education Trust, Applicant – represented by Mr. Kadir {Na} Buksh Umrani Seventy-five years old most corrupt man in the black history of the Islamic Republic of Pakistan, The {Current} Official Assignee in Karachi, Pakistan.
v/s
· City District Government Karachi and Others, Opponent
Please note carefully the following points:
1) The Province of Sindh and the General Secretary of Islamic Education Trust, Syed Kamran Hussain, have both filed an application u/s 12 (2) r/w section 20 of Sindh Rented Premises Ordinance 1979 on dated 7th November 2008.
2) In this application, The Province of Sindh & General Secretary of Islamic Education Trust, Syed Kamran Hussain, has requested the concerned court to dismiss the orders of vacating the Islamia College Complex Karachi.
3) Mr. Hussain’s Counsel claims that the rent or evacuation order that has been issued is strictly against the Islamic Education Trust Deed Reg’d 1958. In the Trust Deed there is no mention of either asking for rent or vacating the building.
4) The Islamic Education Trust is a charitable trust which was built with the sole purpose of educating the masses of students who were unable to get admission at other colleges in Karachi. The order for rent or evacuation of said premises must be recalled.
5) The final argument in the above mentioned case has been held on 24th January 2009. Since that day the case has been held with no final judgment so far. The 3rd Rent Controller East Karachi issued the following dates for this case: first, 10th February 2009; second date of 28th February 2009; third date of 21st March 2009; fourth date of 04th April 2009; fifth date of 30th April 2009; sixth date 20th May 2009. On each of these 6 days, the 3rd Rent Controller East Karachi would simply announce a new date for proclaiming judgment on this case. Now the case has been scheduled after the summer holidays for proclamation of judgment on the 04th July 2009. Since the final arguments have already been urged we request the concerned authorities to order the 3rd Rent Controller East Karachi to kindly announce his judgment in this matter.
6) The City District Government Karachi is already a party in the above mentioned case. However, no counsel has represented the CDGK in this case at all. We request the concerned authorities to kindly question Mr. Manzoor Ahmed, EDO Law & EDO Education, CDGK, why this grave negligence has occurred? Why is the City District Government of Karachi not being represented by a counsel in this case? Do they not know that this is not just 20,000 students, the City District Government is playing with the futures of 20,000 families or should I say the future of Karachi?

For your kind information on 8th November 2008, the General Secretary of Islamic Education Trust [Is the owner of Government Islamia College Karachi], Mr. Syed Kamran Hussain had sent a petition to the President of Pakistan, Mr. Asif Ali Zardari. In this petition Mr. Syed Kamran Hussain has suggested that they have no objection if the government were to acquire the land in order to protect and secure the education of thousands of students which are studying in the said the complex.
The President’s office has forwarded this petition to the Chief Secretary Sindh. This petition has been further forwarded to the Sindh Education Secretary who them forwarded the petition to Mr. Manzoor Hussain Vistro, Section Officer (JUD) for Secretary to Government of Sindh, Education and Literacy Department.
On 17th February 2009, Mr. Vistro had written a letter to The Law Secretary to Government of Sindh, Law Department, Karachi, requesting legal advise as to how the government can come to acquire the Government Islamia College Complex Karachi. Mr. Vistro has sent a second reminder to the same party on 31st March 2009 & third reminder to the same party 23rd April, 2009.
Till date no legal advise has been offered by the Law Secretary to Government of Sindh, Law Department, Karachi as to how the government of Sindh can legally acquire the said premises.
The concerned authorities like you should pressurize the Law Secretary to Government of Sindh, Law Department, Karachi to send their advise as soon as possible.
Further please note the following points:
1. KMC (City District Government Karachi) had allotted the land to the Islamic Education Trust on 27.5.1958 under Resolution No. 1255.
2. In clause No. 4 of this agreement, the Islamic Education Trust was permitted to build ground plus one floor. However, the Islamic Education Trust has violated these terms and conditions, specifically clause No. 4, by constructing ground plus three floors.
3. This property, upon which Islamia College Complex Karachi was built, was granted by the government as a “Pepper Grant” a term used then at Rs. 2/- per annum for education purposes, which is proof that this land is an immunity plot.
4. The City District Government Karachi can legally cancel the 99 years lease of the plot upon which Islamia College Complex Karachi has been built solely because The Islamic Education Trust has violated cause No. 4 of the said agreement.
In order to secure the education and future of 20,000 students, the City District Government Karachi would have to pass a resolution.
We all citizens of Islamic Republic of Pakistan do not want to allow any one to repeat the history of Lal Masjid (Red Mosque) Islamabad in Islamia College Complex Building Karachi. Because Students in Islamia College Complex Building Karachi are equally important as our brothers, our sisters & our children!
We hope that you shall take personal interest for the sake to secure more than twenty thousand student’s education and safety in the above matter and kindly do the needful.

[I] This is regarding High Court Appeal No. 274 of 2008, in the High Court of Sindh, Karachi. This High Court Appeal concerns the rent or execution of Government Islamia College Complex, Karachi.

1. The Appellant has filed this case approximately one month after the deadline set by the High Court of Sindh, Karachi.
2. This negligence can result in this case being dismissed by the High Court of Sindh, Karachi, on the grounds of being time-barred.
3. If this case does not receive a proper and fair trial, the futures of 20,000 students who are currently receiving education at the Islamia College Complex, Karachi, will be in grave danger.
4. We urge the concerned authority to question the Advocate General Sindh, as to how this High Court appeal can be kept alive after this negligence which has been committed by Mr. Abdul Fattah Malak.
5. We request the concerned authorities to instruct the City District Government, Karachi, to become an intervenor in this High Court Appeal, in order to save this appeal.
[II] The following information below is regarding Civil Suit No. 1383 of 2008, in the High Court of Sindh, Karachi. This civil suit also concerns the rent or execution of Government Islamia College Complex, Karachi.

1. The City District Government Karachi has been debarred due to not filing the written statement in the above said civil suit.
2. Please question the concerned authorities, i.e. Mr. Manzoor Ahmed, EDO Education, City District Government Karachi, why this grave negligence has occurred? Were they not aware what impact this would have on the 20,000 students that are currently attending Islamia College Complex Karachi? Do they not know that this is not just 20,000 students, the City District Government is playing with the futures of 20,000 families or should I say the future of Karachi?
3. We request the concerned authorities to instruct the Province of Sindh, to become an intervenor in this Civil Suit, in order to save this suit.
[III] This following information below is regarding Civil case of Execution
No. 17 of 2008 for Rent Case No. 413 of 2004, in the court of 3rd Rent Controller, East, Karachi. This case also deals with the collection of rent or evacuation of Government Islamia College Complex, Karachi.
The parties concerned are:
· Islamic Education Trust, Applicant – represented by Mr. Kadir Buksh Umrani seventy five years old, Official Assignee Karachi
v/s
· City District Government Karachi and Others, Opponent
Please note carefully the following points:
1. The Province of Sindh and the General Secretary of Islamic Education Trust, Syed Kamran Hussain, have both filed an application u/s 12 (2) r/w section 20 of Sindh Rented Premises Ordinance 1979 on 7th November 2008.
2. In this application, General Secretary of Islamic Education Trust, Syed Kamran Hussain, has requested the concerned court to dismiss the orders of vacating the Islamia College Complex Karachi.
3. Mr. Hussain’s Counsel claims that the rent or evacuation order that has been issued is strictly against the Islamic Education Trust Deed Reg’d 1958. In the Trust Deed there is no mention of either asking for rent or vacating the building.
4. The Islamic Education Trust is a charitable trust which was built with the sole purpose of educating the masses of students who were unable to get admission at other colleges in Karachi. The order for rent or evacuation of said premises must be recalled.
5. The final argument in the above mentioned case has been held on 24th January 2009. Since that day the case has been held with no final judgment so far. The 3rd Rent Controller East Karachi issued the following dates for this case: first, 10th February 2009; second date of 28th February 2009; third date of 21st March 2009; fourth date of 04th April 2009; fifth date of 30th April 2009. On each of these 5 days, the 3rd Rent Controller East Karachi would simply announce a new date for proclaiming judgment on this case. Now the case has been scheduled for proclamation of judgment on the 20th May 2009. Since the final arguments have already been urged we request the concerned authorities to ask the 3rd Rent Controller East Karachi to kindly announce his judgment in this matter.
6. The City District Government Karachi is already a party in the above mentioned case. However, no counsel has represented the CDGK in this case at all. We request the concerned authorities to kindly question Mr. Manzoor Ahmed, EDO Law, CDGK, why this grave negligence has occurred? Why is the City District Government of Karachi not being represented by a counsel in this case? Do they not know that this is not just 20,000 students, the City District Government is playing with the futures of 20,000 families or should I say the future of Karachi?

This following information below is regarding civil case of Execution No. 17 of 2008 for Rent Case No. 413 of 2004, in the court of 3rd Rent Controller, East, Karachi. This case also deals with the collection of rent or evacuation of Government Islamia College Complex, Karachi.
The parties concerned are:
· Islamic Education Trust, Applicant – represented by Mr. Kadir {Na} Buksh Umrani Seventy-five years old most corrupt man in the black history of the Islamic Republic of Pakistan, The {Current} Official Assignee in Karachi, Pakistan.
v/s
· City District Government Karachi and Others, Opponent
Please note carefully the following points:
1) The Province of Sindh and the General Secretary of Islamic Education Trust, Syed Kamran Hussain, have both filed an application u/s 12 (2) r/w section 20 of Sindh Rented Premises Ordinance 1979 on dated 7th November 2008.
2) In this application, The Province of Sindh & General Secretary of Islamic Education Trust, Syed Kamran Hussain, has requested the concerned court to dismiss the orders of vacating the Islamia College Complex Karachi.
3) Mr. Hussain’s Counsel claims that the rent or evacuation order that has been issued is strictly against the Islamic Education Trust Deed Reg’d 1958. In the Trust Deed there is no mention of either asking for rent or vacating the building.
4) The Islamic Education Trust is a charitable trust which was built with the sole purpose of educating the masses of students who were unable to get admission at other colleges in Karachi. The order for rent or evacuation of said premises must be recalled.
5) The final argument in the above mentioned case has been held on 24th January 2009. Since that day the case has been held with no final judgment so far. The 3rd Rent Controller East Karachi issued the following dates for this case: first, 10th February 2009; second date of 28th February 2009; third date of 21st March 2009; fourth date of 04th April 2009; fifth date of 30th April 2009; sixth date 20th May 2009. On each of these 6 days, the 3rd Rent Controller East Karachi would simply announce a new date for proclaiming judgment on this case. Now the case has been scheduled after the summer holidays for proclamation of judgment on the 04th July 2009. Since the final arguments have already been urged we request the concerned authorities to order the 3rd Rent Controller East Karachi to kindly announce his judgment in this matter.
6) The City District Government Karachi is already a party in the above mentioned case. However, no counsel has represented the CDGK in this case at all. We request the concerned authorities to kindly question Mr. Manzoor Ahmed, EDO Law & EDO Education, CDGK, why this grave negligence has occurred? Why is the City District Government of Karachi not being represented by a counsel in this case? Do they not know that this is not just 20,000 students, the City District Government is playing with the futures of 20,000 families or should I say the future of Karachi?
